AI Voice Calling for Sales in India: TRAI Rules, DPDP Consent and a Compliant Setup

Voice AI has reached the point where a software agent can hold a natural phone conversation: introduce itself, ask qualifying questions, answer common objections and book a next step. For Indian sales teams that can’t call every enquiry quickly, that is attractive. It is also an area where the regulatory details matter more than the technology, because India’s rules on commercial calls tightened significantly in 2025.

This guide covers how AI calling works, where it is and isn’t appropriate, the TRAI and data-protection rules to follow, and how to design calls that people don’t hang up on. It is not legal advice — review your setup with counsel.

How an AI sales call works

  1. Trigger: a lead arrives (website form, chat, marketplace enquiry) or a campaign list is scheduled.
  2. Dial: the call is placed from a compliant number; busy and unanswered calls are retried later.
  3. Converse: speech recognition converts the person’s reply to text, a language model decides the response within the rules you set, and speech synthesis replies — fast enough to feel conversational.
  4. Qualify and act: the agent asks your qualifying questions and, if appropriate, books a visit or callback.
  5. Record: transcript, summary and extracted details (requirement, budget, timeline) are saved to the CRM.
  6. Follow up: details requested on the call are sent by WhatsApp or email.

The TRAI rules that apply

Commercial calls in India fall under TRAI’s Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018, amended in February 2025. Key points for businesses:

RequirementWhat it means in practice
DLT registrationBusinesses sending commercial communications register as principal entities on telecom operators’ Distributed Ledger Technology platforms before calling.
140 series for promotional callsPromotional voice calls must come from numbers in the 140 series.
160 series for service and transactional callsService and transactional calls (e.g. confirming an order or an appointment the customer booked) use the 1600 series.
No ordinary 10-digit numbersUsing regular 10-digit mobile or landline numbers for promotional, service or transactional calls can lead to disconnection of the sender’s telecom resources, reported as up to two years.
Customer preferences (DND)Promotional calls must respect the customer’s registered preferences unless there is valid consent.

Commentary on the 2025 amendment describes an escalating penalty structure for violations, reported at ₹2 lakh for a first violation, ₹5 lakh for a second and ₹10 lakh for subsequent ones. Check the current regulation text and your telecom provider’s obligations, as operator-level enforcement also applies.

Practical rule: calls to people who asked you to contact them (a form, a chat, a marketplace enquiry) about that request are easier to justify and perform far better than cold lists. Keep a record of how each lead’s consent was captured.

Data protection: DPDP Act and Rules

The Digital Personal Data Protection Rules, 2025 were notified on 14 November 2025 with phased commencement; the bulk of obligations — consent, notice, data principal rights and grievance redressal — apply from May 2027. Calls involve personal data (phone numbers, recordings, transcripts), so plan now:

  • Capture consent on enquiry forms with a clear statement that you may call and message about the enquiry
  • Tell people at the start of the call who is calling and why; if the call is recorded, say so
  • Offer a simple way to stop further calls, and honour it across systems
  • Retain recordings and transcripts only as long as needed, and restrict who can access them

Where AI calling works — and where it shouldn’t be used

Good fitPoor fit
Calling back inbound website, chat and marketplace enquiries within minutesCold-calling purchased lists
Following up trade-show and exhibition contacts who shared detailsNegotiating price on high-value deals
Confirming showroom appointments and deliveries customers bookedSensitive conversations (complaints escalations, collections disputes)
Re-engaging past enquiries with a relevant offer, within consentAnything where a wrong answer creates legal or financial liability

Designing a call brief that converts

The brief is the equivalent of training a new telecaller. Weak briefs create robotic calls; specific ones sound helpful.

SectionExample (furniture showroom)
MissionUnderstand what the caller enquired about, confirm budget and timeline, and book a showroom visit or a callback from a designer.
Opening“Hi, this is Priya calling from Sharma Furniture about your enquiry for a sectional sofa on our website. Is this a good time for two minutes?”
Qualifying questionsRoom size? Fabric or leather? Delivery city? When do you need it?
Facts it can sharePrice ranges by category, delivery areas, customisation lead time, showroom addresses and hours.
RulesNever promise discounts or delivery dates; offer a human callback for custom quotes; end politely if the person is busy.
LanguageMatch the caller — English, Hindi or Hinglish; short sentences.

Measuring it properly

  • Time to first call from enquiry — the main reason to use AI calling at all
  • Connect rate by time of day, to schedule retries well
  • Qualified rate — share of connected calls meeting your criteria
  • Visit or quote rate after human follow-up
  • Opt-out rate — a rising rate means the script or targeting is wrong

Read ten transcripts every week. They show which questions confuse people and what customers actually ask — useful for the website and showroom staff too.

Stuv’s AI calling campaigns call leads sequentially with retries, save recordings, transcripts and summaries to the CRM, and can send a WhatsApp follow-up after the call. Number series, DLT registration and consent capture remain your responsibility as the sender.

Frequently Asked Questions

Which number series must promotional calls use in India?

Under TRAI’s TCCCPR as amended in 2025, promotional voice calls must use 140-series numbers, and service or transactional calls use the 1600 series. Using ordinary 10-digit numbers for these calls can lead to disconnection of the sender’s telecom resources.

Do I need DLT registration for AI calling?

Businesses making commercial calls are required to register on telecom operators’ DLT platforms. Registration alone isn’t enough — the calls must also come from the correct number series.

Does the DPDP Act affect AI sales calls?

Yes. Calls involve personal data such as phone numbers, recordings and transcripts. The DPDP Rules, 2025 phase in obligations, with most consent and notice requirements applying from May 2027. Capture clear consent and allow easy opt-out.

Should AI calling replace human salespeople?

No. It works best for fast first contact, qualification and appointment confirmation, with humans handling negotiation and closing.
